🏢 Who We Are and Who You Are

"Trollspace", "Service", "Platform", "we", "us", or "our" refers to Daniel Tollefsen, established under the laws of Norway.

"You" or "User" refers to the individual using the Service, or, where applicable, the organization on whose behalf that individual is using the Service. If you sign up using a business email or otherwise on behalf of an organization, you represent and warrant that you have authority to bind that organization, and "you" will refer to that organization.

📄 Acceptance of Terms

These Terms and Conditions ("Terms") govern your access to and use of Trollspace, a personal content organization and management platform.

By creating an account, accessing, or using any part of the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy, which describes how we collect and use personal data.

If you do not agree to these Terms, you must not access or use the Service.

👥 Eligibility

You must meet the following requirements to use the Service:

• You must be at least 13 years old
• You must provide accurate and complete registration information
• You must not be prohibited from using the Service under applicable laws
• You must have the legal capacity to enter into a binding agreement

If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

🛡 Account Registration and Approval

Account Creation

To use Trollspace, you must create an account by providing a valid email address and password. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities under your account

Approval Process

Trollspace operates on an approval-based access model. After registration:

• Your account will be in a "pending" status awaiting administrator review
• We reserve the right to approve or reject any registration at our sole discretion
• We are not obligated to provide reasons for rejection
• You may not create multiple accounts to circumvent rejection
• Approval grants you access to the Service subject to these Terms

✅ User Responsibilities

As a user of Trollspace, you agree to:

• Use the Service only for lawful purposes and in accordance with these Terms
• Not use the Service in any way that violates applicable laws or regulations
• Respect the intellectual property rights of others
• Safeguard your API keys and integration credentials
• Not share your account credentials with third parties
• Report any security vulnerabilities or bugs to support@trollefsen.com
• Use reasonable judgment when storing sensitive information

Prohibited Data Types

You acknowledge that the Service is not designed for and you must not use it to store:

• Special categories of personal data as defined under the GDPR (such as health information, data revealing racial or ethnic origin, political opinions, or religious beliefs)
• Personal data of children under 13
• Any data subject to specific sectoral regulations requiring dedicated compliance frameworks (for example, payment card data under PCI-DSS, protected health information under HIPAA), unless we have expressly agreed to such use in a separate written agreement

🚫 Prohibited Activities

You are expressly prohibited from:

• Using the Service to store, transmit, or distribute illegal content
• Attempting to gain unauthorized access to the Service, other accounts, or systems
• Interfering with or disrupting the Service or servers
• Reverse engineering, decompiling, or disassembling the Service
• Using automated systems (bots, scrapers) without explicit permission
• Engaging in any form of data mining or harvesting
• Impersonating another person or entity
• Transmitting viruses, malware, or malicious code
• Overloading the Service or engaging in denial-of-service attacks
• Violating any third-party terms of service for integrated services
• Using the Service to harass, abuse, or harm others
• Selling, renting, or sublicensing access to your account

🔒 Content Ownership and License

Your Content

You retain all ownership rights to the content you create, upload, or store in Trollspace ("Your Content"). This includes:

• Code snippets, notes, ideas, and todos
• Travel data, photos, and personal information
• Music and movie entries
• Knowledge base articles and documentation
• Financial tracking data
• Any other content you create or upload

License to Us

By uploading Your Content, you grant us a limited, non-exclusive, worldwide, royalty-free licence to:

• Host, store, reproduce, and display Your Content as necessary to operate and provide the Service to you
• Process Your Content to generate AI-powered features, insights, and recommendations that you request or enable
• Create encrypted backups and maintain technical logs for security, reliability, and disaster-recovery
• Analyse aggregated and/or de-identified data derived from Your Content and your use of the Service to maintain, secure, and improve the Service

Content Responsibility

You are solely responsible for Your Content. You represent and warrant that:

• You own or have the necessary rights to Your Content
• Your Content does not violate any third-party rights
• Your Content complies with applicable laws and these Terms
• Your Content does not contain viruses or malicious code

🔗 Third-Party Services and Integrations

Third-Party Infrastructure and Sub-Processors

We use third-party providers to host and operate the Service, including cloud infrastructure, databases, storage, authentication, logging, and AI models (for example Supabase, OpenAI, Google, and other vendors described in our Privacy Policy). These providers may process Your Content and other data on our behalf to deliver the Service.

User-Connected Integrations

Trollspace integrates with various third-party services (GitHub, Spotify, TMDB, Google, Binance, etc.). When using these integrations:

• You are responsible for complying with each service's terms of service
• You must have valid credentials and authorization to connect these services
• You are responsible for any costs associated with third-party services
• We are not responsible for the availability or functionality of third-party services
• Third-party service interruptions may affect Service functionality
• You may disconnect integrations at any time from the Integrations page

We are not responsible for changes made by third-party providers (such as API changes, model behaviour, outages, or deprecations) that may affect the Service, but we will make reasonable efforts to adapt the Service where feasible.

We do not endorse, guarantee, or assume responsibility for third-party services, even if integrated with our platform.

⚙ API Usage

If you use our public API (see API documentation):

• You must authenticate properly and keep your API credentials secure
• You must respect rate limits and usage quotas
• You must not use the API to circumvent Service limitations
• We reserve the right to modify, suspend, or terminate API access
• API access may be subject to additional terms and restrictions

🌍 Service Availability and Modifications

We strive to provide reliable Service, but:

• The Service is provided "as is" without uptime guarantees
• We may experience downtime for maintenance, updates, or emergencies
• We reserve the right to modify, suspend, or discontinue any feature
• We may update these Terms and notify users of material changes
• Continued use after changes constitutes acceptance of new Terms

Beta and Preview Features

From time to time, we may offer new features (including AI-powered features) labelled as beta, preview, or early access. Such features are provided "as is", may be subject to additional terms, may be modified or discontinued at any time, and may not be covered by the same support or stability commitments as the rest of the Service.

We will make reasonable efforts to notify users of significant changes or planned downtime.

💰 Fees and Payment

Trollspace is currently provided free of charge. However:

• We reserve the right to introduce paid features or subscription tiers
• Users will be notified at least 30 days before any fee implementation
• Third-party service costs (API usage, etc.) are your responsibility
• Free access may be limited or restricted in the future

© Intellectual Property

The Service, including its design, code, graphics, and content (excluding Your Content), is owned by Trollspace and protected by intellectual property laws.

You may not:

• Copy, modify, or distribute the Service's code or design
• Remove or alter any copyright, trademark, or proprietary notices
• Use our trademarks or branding without permission
• Create derivative works based on the Service

⚠ Disclaimer of Warranties

We explicitly disclaim all warranties, express or implied, including but not limited to:

• Warranties of merchantability and fitness for a particular purpose
• Warranties of non-infringement
• Warranties regarding accuracy, reliability, or completeness
• Warranties that the Service will be uninterrupted or error-free
• Warranties that defects will be corrected

You use the Service at your own risk. We do not guarantee that the Service will meet your requirements or that it will be secure.

⚖ Limitation of Liability

Trollspace, its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, or data
• Business interruption or loss of opportunity
• Unauthorized access to your account or content
• Third-party actions or service failures
• Errors, bugs, or security vulnerabilities
• Loss or corruption of Your Content

Our total liability to you for any claims arising from or related to the Service shall not exceed $100 USD or the amount you paid us in the past 12 months, whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of liability, so these limitations may not apply to you.

🛡 Indemnification

You agree to indemnify, defend, and hold harmless Trollspace, its owners, employees, and affiliates from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your Content or activities on the Service
• Unauthorized access to your account due to your negligence

❌ Termination

Termination by You

You may terminate your account at any time by contacting us at support@trollefsen.com. Upon termination:

• Your access to the Service will be revoked
• Your data will be deleted within 30 days (except as required by law)
• Backups may persist for up to 90 days

Termination by Us

We reserve the right to suspend or terminate your account immediately, without notice, if:

• You violate these Terms or our policies
• Your account is involved in illegal activities
• Your account poses a security risk
• We discontinue the Service
• We determine termination is necessary at our sole discretion

Effect of Termination

Upon termination, all licenses granted to you under these Terms will immediately cease. Provisions that should reasonably survive termination (disclaimers, limitations of liability, indemnification) will remain in effect.

⚖ Governing Law and Disputes

These Terms are governed by the laws of Norway, without regard to its conflict-of-law rules.

Any dispute arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Norway.

You waive any right to participate in class action lawsuits or class-wide arbitration.

📋 General Provisions

Entire Agreement

These Terms, together with our Privacy Policy and any applicable DPA, constitute the entire agreement between you and Trollspace regarding the Service.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

Assignment

You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms without restriction.

Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control.

🔄 Changes to These Terms

We reserve the right to modify these Terms at any time. When we make changes:

• We will update the "Last updated" date at the top
• For material changes that negatively affect your rights, we will provide reasonable advance notice where possible
• We may display a prominent notice in the Service
• Changes become effective immediately upon posting unless stated otherwise

If you do not agree to the revised Terms, you must stop using the Service and terminate your account before the changes take effect. Your continued use of the Service after the effective date constitutes your acceptance of the revised Terms.
